Non-Disclosure Agreement

Ebook Designer Studio keeps all ongoing projects strictly confidential at all times. This means that Ebook Designer Studio is not authorized to discuss, transfer, display, (etc.) any part of your project to individuals outside of our operations. All files of our clients are handled with strict professionalism, locked securely away by authorized management, & is accessible only by them. It is to be noted, however, that Ebook Designer Studio is not responsible for the breach of confidentiality outside of our control.

In obligation to us, the client is required to honor the Non-Disclosure Agreement by keeping the project strictly confidential. In the event that the client has publicly discussed, transferred, or displayed any part of their project to individuals outside of our operations, this Non-Disclosure Agreement is null & void. This NDA activates upon confirmation of submitted Work Order & expires upon the completion of project. Client information after project completion will remain confidential, but Ebook Designer Studio will not be required to uphold confidentiality of non-personal client information. The client agrees to this NDA policy upon submission of any Work Order.

By accessing this / issuing payment on / requesting work orders on http://www.ebookdesignerstudio.com, you are agreeing to be bound by these web site terms & privacy policy, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this web site are protected by applicable copyright and trade mark law.

By issuing payment & submitting work orders, you agree that you are bound to these terms for the entire duration of your project.

2. Use License

  1. Permission is granted to temporarily download one copy of the materials (information or software) on Ebook Designer Studio's web site for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license you may not:
    1. modify or copy the materials;
    2. use the materials for any commercial purpose, or for any public display (commercial or non-commercial);

6. Refund Policy

Ebook Designer Studio and its staff is accountable to the obligation of refunding all payments 100% to customers in the case that the company & its staff has failed to meet certain conditions. Conditions include:

  1. Failing to complete a finished design on the latest deadline date as advertise on the offered service to complete that service.
  2. In the case that there is an unintended copyright violation on our part with any licensed image used.
  3. Our reservation to refund anyone at anytime for any reason.

Under our obligations, we must give you a refund under those conditions. HOWEVER, YOU AGREE THAT THE FOLLOWING CIRCUMSTANCES MAKES YOUR PURCHASE NON-REFUNDABLE:

  1. If the designer assigned to you has already created a finished design awaiting your approval & you want a revision. Customers asking for revisions on finished designs risks exceeding the deadlines as advertised on our services to complete that service. Under this circumstance, a refund cannot be issued for missing a deadline.
  2. The customer fails to complete a work order form within 48 hours of your sales order. YOU ARE REQUIRED TO COMPLETE A WORK ORDER FORM WITHIN 48 HOURS TO QUALIFY FOR THE REFUND POLICY.
  3. The customer fails to repond to phone calls, emails, or any other type of communication in which your assigned designer is requesting information to complete your project. Failure to communicate with your designer endangers deadlines outside of our control, which disqualifies the customer from this refund policy.
  4. The designer terminates the contract because the customer engaged in (but not limited to):
    1. Death threats
    2. Racism or other hateful communications
    3. Personal Misconduct
    4. Unwanted solicitation
    5. Breaching the "NBC Associated Broadcasting Limitations & Restrictions Agreement"

7. Licensed Material Policy

Ebook Designer Studio protects customers using images that are allowed to be used commercial for customer projects or designed originally by us. The company also respects the copyright of all intellectual owners. Therefore, this Licensed Material Policy is VOID if the customer sends us images or graphics required to be used that are copyright. The customer also forfeits both their refund & unlimited revisions policies if Ebook Designer Studio is aware of the infringement violation by the customer. Copyright violations by Ebook Designer Studio are unintentional, but will award the customer a 100% refund A.S.A.P. if the company is in violation of copyright with its own images.

8. Unlimited Revisions Policy

Customers are protected by an unlimited revision policy that allows them to have unlimited updates to their project. The unlimited revision policy is active FOR 10 BUSINESS DAYS AFTER THE LATEST DEADLINE. For example, if you ordered a service that requires 3-5 days to complete, you will have approximately 15 guaranteed business days of unlimited revisions. After this time passes, Ebook Designer Studio reserves the right to terminate any project at any time. The customer also agrees that the payment is non-refundable if they request revisions that noticeably exceed the advertised deadlines of all services rendered.

9. Links

Ebook Designer Studio has not reviewed all of the sites linking to it and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Ebook Designer Studio. Use of any such linked web site is at the user's own risk.

10. Site Terms of Use Modifications

Ebook Designer Studio may revise these terms of use for its web site at any time without notice. By using this web site you are agreeing to be bound by the then current version of these Terms and Conditions of Use.

11. Governing Law

Any claim relating to Ebook Designer Studio's web site shall be governed by the laws of the State of Oklahoma without regard to its conflict of law provisions.

Completion Time Agreement

All orders made on EbookDesignerStudio.com will specify a time frame in which the project will be completed. The completion time is specified in BUSINESS DAYS. Business days on EbookDesignerStudio.com are considered MONDAY THROUGH FRIDAY FROM 10 A.M. TO 4. P.M. CST (Time zone is subject to change without notice).

This means, for example, that if you place an order that requires 3 business days to complete the project on a Friday at 5 p.m. CST, the first business day WILL NOT BEGIN until Monday at 10 a.m. CST. The project must then be completed by Wednesday at 4. P.M. CST or it will be considered late. Under this rare circumstance, you are entitled to a refund.

NBC Associated Broadcasting Limitations & Restrictions Agreement

To maintain the quality of our promotional services to all of our customers, we maintain a strict policy of what products & services we do not allow to be broadcasted under any circumstances.

These products & services include but is not limited to:

  • Cash gifting
  • Prescription drugs or devices (which includes but is not limited to controlled substances), drugs & drug devices unapproved by the FDA
  • Hazardous materials, combustibles, corrosives & pesticides
  • Burglary tools
  • Regulated plants & insects
  • Promotion of hatred, racism, sexism, religious persecution and any other predujicial views.
  • Housing discrimination - Promotion and/or preference of the discrimination of race or color, sex, religion, national origin, familial status, or Handicap / Disability
  • Illegal downloads or any goods & services infringing intellectual property rights of a third party.
  • Pre-teen/Adult material - such as pictures, videos, etc., of minors (individuals under the age of 18)
  • Prostitution
  • Weapons such as firearms, undetectable or switch blade knives, martial arts weapons, scopes, silencers, ammunition, ammunition magazines, BB guns, tear gas or stun guns
  • Infringing any third-party copyright, patent, trademark / secret,or other property rights or rights of publicity or privacy.
  • Promotion of spam
  • Money Laundering
  • Blood, bodily fluids or body parts
  • Stolen property (or property with serial number removed / manipulated)
  • Counterfeit items & currency
  • Used / Refurbished batteries
  • Non-packaged food items or adulterated food
  • Material with sensitive information such as mailing lists that contain names, addresses, phone numbers, or other personal identifying information
  • False identification cards, items personating police, citizenship documents, or birth certificates
  • Illegal telecommunication equipment (access cards, password sniffers, access card programmers and unloopers, or cable descramblers)
  • Any defamatory, slanderous, trade libelous, unlawfully threatening, or harrassing statements or information.
  • Practices violating any law, statute, ordinance, contract, or regulation - including but not limited to those governing financial services, consumer protection, unfair competition, anti-discrimination or false advertising.
  • Using or selling any form of e-cash, web cash or any other kind of currency, tangible or not, that is redeemable by a Buyer for a product or service from a third party.
  • Any company in the practice of submitting altered documentation, such as verification documents & forged signatures

If your product or service is one of these mentioned items above, your cover designing services will still be granted, but you will not qualify for an NBC broadcast. It is your sole responsibility to check & verify that your product or service is acceptable for an NBC broadcast & agree that Ebook Designer Studio is not responsible for any rejections.

Ebook Designer Studio reserves the right to decline any product or service for an NBC broadcast.
